This Terms of Use Agreement (“Agreement”) is between Robert Peterson, Attorney at Law, P.C. (‘company”, “us”, “we”) and the User of the www.attorneyrobertpeterson.com (“Website”, “Site”).

Choice of Law and Jurisdiction

The Terms of Use and the rights and obligations of Robert Peterson, Attorney at Law, P.C. and Users shall be governed and interpreted by United States and Michigan law and any legal action concerning the Terms of Use shall be brought in the courts of Ontonagon County, Michigan.


Indemnification

In the event that a User violates any of the Terms of Use or applicable laws or regulations, the User agrees to be responsible for indemnifying the company for any losses or damages that the company incurs as a result. The company cannot be held responsible for any claim involving the User as stated in our Disclaimers.


Warranties

Robert Peterson, Attorney at Law, P.C. has not made and does not make any promises, guaranties or warranties concerning any matters or statements on this website or concerning any litigation or outcome of a case or settlement of a case. Information on this website is provided on a use-at-your-own risk basis and we will not be liable for any misuse, misinterpretation, or mistake concerning this website.


Waiver

The Company and Users covenant and agree that if either Party fails or neglects for any reason to take advantage of any of the terms provided in this Terms of Use, shall fail to do so, any such failure or neglect by such Party shall not be a waiver or be deemed or be construed to be a waiver of any cause for the termination of this Agreement subsequently arising, or as a waiver of any of the terms, covenants or conditions of this Agreement or of the performance thereof. None of the terms, covenants and conditions of this Agreement may be waived by a Party except by its written consent.


Force Majeure

No liability hereunder shall result to a User by reason of delay in performance caused by force majeure, that is circumstances beyond the reasonable control of the Party, including, without limitation, acts of God, fire, flood, war, terrorism, civil unrest, labor unrest, or shortage of or inability to obtain material or equipment.


Attorneys’ Fees and Costs

In the event that the Company shall bring an action or legal proceeding for an alleged breach of any provision of this Agreement or any representation, warranty, covenant or agreement herein set forth, or to enforce, protect, determine or establish any term, covenant or provision of this Agreement or the company rights hereunder, the Company, if prevailing, shall be entitled to recover from the User, as a part of such action or proceedings, or in a separate action brought for that purpose, reasonable attorneys’ fees and costs, expert witness fees and court costs as may be fixed by the court or jury.


Jury Trial waiver

The Company and User hereby irrevocably waive, to the fullest extent permitted by applicable law, any and all right to trial by jury in any legal proceeding arising out of or relating to this Agreement, or transactions related to the Terms of Use.


Severability

If any provision of this Terms of Use shall be determined by any court as invalid or unenforceable, it is the agreement between the company and the User that the remaining provisions of the Terms of Use remain in full force and effect, and the affected provision or portion thereof will be deemed modified so that it is enforceable to the maximum extent permissible to reflect as closely as possible the intention of the parties as evidenced from the provisions of this Terms of Use.

The Section Headings used herein are intended for convenience of reference only and are not to be considered in interpreting the Terms of Use.


Entire and Final Agreement

The Terms of Use herein constitutes the entire agreement between Robert Peterson, Attorney at Law, P.C. and Users. There are no other prior written or oral agreements between our company and Users of our Website concerning the Terms of Use. Any prior Agreements are merged in and superseded by this version of the Terms of Use. No statement, representation, warranty, covenant or agreement of any kind not expressly set forth in the Terms of Use shall affect, or be used to interpret, change or restrict, the express terms and provisions of the Terms of Use.
